Notices: GUESTS AND TENANTS: The real estate licensee will be representing the owner and will be the lawful agent of the owner of the real property involved, unless otherwise disclosed in writing.

While we make every effort to ensure the accuracy of property descriptions, we cannot be liable for changes in equipment and furnishings for individually owned properties, any misinformation, typographical errors, withdrawn properties, etc., herein contained. All persons are hereby informed that all dwellings are available on an equal opportunity basis. Rental rates and availability are subject to change without notice.

Occupancy Guidelines

It is the policy of Long & Foster Real Estate, Inc. to issue a license to occupy (1) to family groups only, or (2) to non-family groups wherein at least at least two guests signing the lodging agreement are 25 years of age or older and will be in the residence to supervise and be responsible for members of the group who are under 25 years of age. A family group is defined as parents, grandparents, children, and extended family members vacationing in one property. A non-family group is defined as unrelated adults, high school student, college student, or any other group type situation not meeting the age requirement stipulated herein. Should Long & Foster Real Estate, Inc. personnel ascertain a non-family group is occupying a property in violation of the age requirement; the group is subject to immediate termination of the lodging agreement with no refund. Long & Foster Real Estate, Inc. reserves the right to refuse occupancy, cancel existing reservations, and return money received, and/or terminate occupancy without refund if the occupancy, in our opinion, is detrimental to the property and its owner, whom we represent.

Reservations & Deposits

To reserve a home, you can check availability and book online at https://lfvacations.com or you may call out offices between 9am to 5pm 7 days a week.

After making your reservation, we will send you a Lodging Agreement requesting your first payment, which amounts to 50% of the rent plus a $60 non-refundable processing fee and a $50 non-refundable accidental damage protection fee, optional Travel Insurance coverage and optional Linens. You must return your signed Lodging Agreement to us with your advance payment or your reservation will be cancelled without notice. If you do not wish to purchase the optional Travel Insurance or Linens, please initial to decline it on your Lodging Agreement Addendum.

Payment

Your final payment is due to Long & Foster THIRTY (30) days prior to check-in or Guest shall not be entitled to possession unless and until full amount owed herein has been paid to Long & Foster. Failure by the Guest to make payment by cash or certified check of any balance due within 24 hours of the arrival date or notify Long & Foster Rental Agent in writing of delayed check-in, the reservation will be canceled and entire rental amount forfeited.

Last Minute Travel

All reservations made within 30 days of your arrival date will require full payment within 24 hours. We will fax or email you a Rental Lodging Agreement that needs to be faxed back with your signature and credit card payment (Master Card, Visa or Discover) or you can overnight certified funds with your signed Lodging Agreement to our office.

Returned Checks

There will be a return check charge of $25. Returned checks must be replaced with certified fund or a credit card payment.

Partial Week Rentals

Some homes allow partial week rentals with a 3-night minimum.

Reservation Fee

In addition to your rental charge, all reservations will be charged a processing fee and applicable taxes. The processing fee covers the cost of processing the reservation.

Accidental Damage Program

The Accidental Damage Program is a non-refundable fee covering accidental damages and repairs up to a limit of $1,000. Guest covenants and promises to surrender Property in as good or same condition as at the commencement of occupancy, reasonable wear and tear accepted. Guest is financially responsible for any damage to the Property made by himself, his family or his guest(s) and any damage inflicted on the Property during the stay. Owner and Agent reserve the right to inspect and make repairs to the Property during the lodging period and may inspect the property at the conclusion of this Agreement. In the event the said Property is made uninhabitable by reason of fire or other unavoidable accident, the Agreement hereunder will be terminated and Guest shall be entitled to a pro-rate refund from Owner.

Move-out Deposit

The Property Owner may choose to retain a move-out deposit I lieu of the Accidental Damage Program.

In the event that there are no outstanding damages or expenses incurred to repair or clean the Property after the Guest’s possession of same hereunder, the security deposit where applicable will be returned to the Guest, within a reasonable period of time not to exceed thirty days after the Guest, Family Members and/or Guest invitees cease to occupy the Property.

DAMAGES MUST BE REPORTED IMMEDIATELY IN ORDER FOR THE RENTAL AGENCY TO REPAIR/REPLACE SAID DAMAGES. OTHERWISE, ALL DAMAGE COSTS CAUSED BY GUEST(S) DURING THE OCCUPANCY WILL BE THE RESPONSIBILITY OF THE GUEST.

Cancellation

To cancel a confirmed reservation, please call us as soon as you know you will be unable to vacation to give us as much time as possible to re-rent your home. We will need written notification of cancellation signed by the Guest that can be sent via mail, fax or e-mail. Note: a percentage of the total lodging fees, plus a processing fee, will be charged for cancellations provided the property is re-rented for the full amount. If property is not re-rented for full amount, funds returned to Guest will be pro-rated accordingly. Guest agrees this Agreement may not be assigned or the property sublet for any reason. If Guest has not checked in within 24 hours of arrival date, or notified agent in writing of delayed check-in, reservation will be cancelled and entire rental amount forfeited. If property is not re-rented, Guest forfeits all funds received for this lodging. No refunds given for inclement weather including hurricanes. If you purchased the optional Travel Insurance, that insurance premium will not be refunded.

Travel Insurance

CSA Travel Insurance is ONLY offered at the time of booking and at final payment. The best way to guarantee a worry-free vacation! You have the option of protecting your vacation investment through the purchase of trip insurance. Although this insurance is optional, we highly recommend purchase of this coverage for your financial protection in unforeseen cancellation situations. For more information call CSA at 866-999-4018. WE STRONGLY ENCOURAGE YOU TO PURCHASE THIS COVERAGE TO PROTECT YOUR VACATION INVESTMENT.

Check-In and Late Arrivals

Check-in at the Long & Foster offices begins at 3:00 pm. If you will be arriving after 5:00 pm, arrangements must be made with the office staff for late arrival. If Guests has not checked in within 24 hours of the reservation date, unless prior notification has been made, the rental funds may be forfeited and the unit re-rented.

Check-Out and Departure, 10:00am

We are sorry you have to leave at all, however, we must insist on a 10 AM Check-out time. Please check out promptly by 10 am so the property may be readied for the next guest. We ask that this policy be recognized by all Guest(s). Late departures will be charged a late check-out fee. Please leave the property neat and orderly. There are no refunds for early departures.

Pet Policy

Pets are allowed in some of the properties with prior owner approval. If you are staying in a property where pets are not allowed and pets are found on the premises, you are subject to termination of License Agreement without refund. There are several kennels in the area and your agent will be happy to provide you with the information. Homes are not guaranteed allergen-free, even those that do not allow pets.

Non-Smoking Units

Properties may be smoking or non-smoking. Please be specific with your request when booking. Should we determine that during a Guest stay the non-smoking property rules have been violated, a $200 fumigation charge will be levied to the Guest account.

Maintenance

It is impossible to guarantee that all appliances, hot water heaters, etc. will be in working order 100% of the time. We do guarantee to make every effort to correct all deficiencies as soon as possible during normal business hours. Management reserves the right to perform necessary repairs during your stay. We will do our best to do so without an inconvenience to you.

Availability & Use

It is hereby understood and agreed that should a property be made unavailable by fire or other reason beyond the control of Long & Foster or the Owner, the lodging fees will be refunded to the Guest(s) and where necessary pro-rated for the term of the stay.

Features & Furnishings

The rental homes offerings by Long & Foster are privately owned and are decorated and furnished to suit the owner’s taste and needs. Accommodations and amenities vary greatly. Please make sure that you inquire about your specific needs. Items that are NOT SUPPLIED are bed linens, blankets, towels, soap, and paper products. Linens, rollways, cribs, high chairs, strollers, and beach equipment may be rented. Contact your agent for further information.

Making Your Reservation

To reserve a home or condominium, you can check availability and book online at https://lfvacations.com or you may call our offices between the hours of 9am to 5pm, 7 days a week. After your reservation is made, we will send you a Lodging Agreement. You must sign, and return the Lodging Agreement to confirm your reservation. For reservations made less than 30 days prior to arrival, Lodging Agreements must be faxed, emailed or returned by “next day” service.

Unless arrangements have been made in advance with your rental agent, keys will be issued to the Guest making the reservation.

Capacity Considerations & Noise

Our homes are to be used for the QUIET enjoyment of our guests and NOT to be used for parties, large gatherings or receptions beyond the sleeping capacity of the home. “Disturbing the Peace” may result in termination of the Lodging Agreement. The capacity of the home as stated on the Lodging Agreement and the parking capacity cannot be exceeded. No campers or camping on the grounds of the rental home will be allowed.

Parking (Autos, Campers &, Trailers)

Our vacation homes provide ample parking as noted on our website in the amenities section for each home or condominium. The number of parking spaces is based on the space available for standard automobiles. Parking on city streets is illegal except where designated and may require a parking permit. Campers and boats are not allowed in some areas.

Barbecues

Use of barbeques, where permitted, is limited to sand or parking areas – not on any part of buildings or decks. Condominiums do not permit grilling. Grills are left as a courtesy of the owner and may not be guaranteed (including gas refills).

Telephone Service & Internet

Most properties no longer have long distance telephone service. The unit telephone number is printed on your confirmation. It is important that you leave the phone number for the property you have rented with relatives and emergency contacts. There is no mail service to our homes. Internet is not available in all properties. Please check with your rental coordinator for availability.

Lost and Found Personal Property

Long & Foster and/or the property owner are not responsible for personal property left behind, stolen or damaged during your stay. Never leave valuables (cash, wallets, jewelry, cameras, etc.) unattended. If you find you have left something behind, call our office and we will try to locate the missing item(s). If the item(s) is located it will be returned to you at your expense.

Keys

You will receive two sets of keys at Check-in. Extra sets may be requested. If you are locked out of your vacation home during business hours, please come by the office for a loaner key. After hours, up until 9pm, there is a $75.00 fee payable in cash or check, and we will meet you at the office with a loaner key. $25.00 will be charged for each lost key.

Television, Stereo & CD Players

Because our units are privately owned homes the method and level of TV service (cable, satellite, antenna) is determined by the owners and by the service that is available in the area. Premium channels are typically NOT available. Long & Foster assumes no responsibility for TV reception or operation and cannot guarantee that specific channels will be available. Not all units are equipped with stereo or CD Players. The above items are offered as a convenience to the Guest(s) and are not guaranteed.

Swimming Pools

Most pools are open from Memorial Day to Labor Day (some do not open until mid-June). Days and hours of operation are at the discretion of the condominium or club management.

Sea Colony, Bethany Beach, DE

If you are staying at Sea Colony there will be a charge of $35 per person per week for the use of the recreational facilities. This is paid directly to Sea Colony after you have checked in at our office. Price is subject to change without notice.

Construction

There may be beach nourishment or construction activity near your vacation accommodations. We cannot be responsible for such activity so please do not request to be moved. Should there be a request for an adjustment in the rental amount it should be provided in writing and it will be at the discretion of the property owner.

Unnecessary Service Calls

Our staff experiences calls for services that are due to guest unfamiliarity with the property amenities. This is especially true on check-in day with refrigeration service calls. Often the situation can be solved by following the phone instructions of our staff. Should a service repairman needs to be sent to the property and it is determined that the situation could have been resolved by following the instructions; you will be responsible for the service call invoice.

Owner Closets

The owner of the home that you occupy may have a locked owner closet. Access to this closet is not included in your rental.
